By accessing or using the Smart Balance® mobile application (“App”), Smart Balance® mattress system, and related services (collectively, the “Services”), you agree to be bound by this User Agreement (“Agreement”).

If you do not agree to these terms, please do not use the Services.

To use certain features, you must create an account.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate this Agreement.

You agree to use the Smart Balance® system in accordance with provided instructions.

• The mattress must be used as intended, including correct orientation (Head Side / Foot Side)
• You must not misuse, modify, or tamper with the product
• You must not interfere with system functionality

Improper use may affect performance and safety.

Your use of the Services is also governed by our Privacy Policy.

Please review our Privacy Policy to understand how your information is collected and used.

All content, technology, and materials related to the Services, including:

• Software
• Algorithms
• Designs
• Trademarks (including Smart Balance®)

are the property of Akeso Inc. and are protected by applicable laws.

You may not:

• Copy
• Modify
• Distribute
• Reverse engineer

any part of the Services without prior written consent.

You agree not to:

• Reverse engineer or attempt to extract source code
• Use the Services for unlawful purposes
• Interfere with or disrupt system operations
• Use the product in a manner inconsistent with instructions

We may:

• Update or modify the App and Services
• Add or remove features
• Improve system performance

We may also update this Agreement from time to time.

Smart Balance® is designed to improve sleep experience through adaptive support.

However:

• Results may vary by individual
• No guarantee of sleep improvement is provided

Performance depends on various factors including user behavior, environment, and individual conditions.

The Smart Balance® mattress can function without the App.

The App provides additional features, including:

• Personalized settings
• Sleep insights and analytics

Use of the App is optional but enhances functionality.

Sleep data and insights provided by the Smart Balance® system are estimates based on collected data and algorithms.

We do not guarantee:

• Accuracy
• Completeness
• Reliability of such data

The Services are provided “as is” and “as available.”

We make no warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

To the fullest extent permitted by law, Akeso Inc. shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of use, data, or sleep-related outcomes
• Damages resulting from misuse of the product
